DeSantis’ stay-at-home order means gun shops can stay open, providing huge victory for 2A

When Florida Governor Ron DeSantis issued his executive order EO 20-91 today, he specified that “essential services means and encompasses the list detailed by the U.S. Department of Homeland Security in its Guidance on the Essential Critical Infrastructure Workforce, v. 2, March 28, 2020.”

What does that mean in practice? It means that gun shops stay open, something which other news outlets appear to not have noticed yet.

The specific guidance from  Homeland Security that DeSantis referenced states that the workforce includes “workers supporting the operation of firearm or ammunition product manufacturers, retailers, importers, distributors, and shooting ranges.”

DeSantis has the power to regulate firearms during a declared state of emergency under Florida Statutes 252.36(3)(h), However, it is less clear whether other parts of his executive order are lawful because he did not cite specific authority as he did in EO 20-68.

DeSantis continues to simply citing the 26,000 word chapter 252 without specific reference to exactly where in that chapter of Florida Statutes he found the power to do so…as he did in the previously referenced EO 20-68.

In any event, DeSantis inclusion of the DHS guidelines is a victory for Second Amendment advocates, who at this time would rather not have to fight the governor in court, and instead focus on protecting their families and properties should that become necessary. Let’s hope it doesn’t.

While some media outlets try to smear DeSantis by always using unflattering images of him, The Guardian uses the same image of him whether we report favorably, report unfavorably, or use him in an April Fool’s prank article that is neutral about him.
